Terms of Use

These terms cover your use of Inkwelo, a writing app for macOS. In them, "we", "our" and "us" mean the publisher of Inkwelo. By installing or using the app you accept these terms. If you do not accept them, do not use the app.

The short version. Inkwelo is a one-time purchase, not a subscription. You may install it on the Macs you own or control. Your documents are plain files on your own disk and they remain entirely yours — we have no access to them and claim no rights over them. Because Inkwelo is sold through the Mac App Store, Apple handles payment and refunds. Keep backups: the app is provided as-is and we cannot be liable for lost work.

1. The app and what it needs

Inkwelo requires macOS 26 or later and runs on Apple Silicon and Intel Macs. On-device grammar checking requires an Apple Silicon Mac and is available in English only. These requirements may change in future versions, and we will state them on the App Store listing and at inkwelo.com.

2. Your licence

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Inkwelo on Apple-branded devices that you own or control, in accordance with the App Store's usage rules.

Inkwelo is distributed through the Mac App Store, so Apple's Licensed Application End User Licence Agreement and the Apple Media Services Terms and Conditions also apply to your copy. These terms supplement them. Where a conflict is unavoidable, Apple's terms govern the matters they cover — including family sharing, device limits and store rules — and these terms govern everything else.

Inkwelo is licensed to you, not sold, and we retain all rights not expressly granted. This does not affect your ownership of your own writing, which is dealt with in section 6.

3. What you may not do

Nothing here restricts what you may write with Inkwelo. We do not review, moderate, approve or have any knowledge of what you produce with it.

4. Trial, price and purchase

Inkwelo offers a 14-day trial of the full app. No account is required to use it.

After the trial, continued use requires a one-time purchase of US$29.99, or the equivalent in your local currency as set by Apple's pricing for your storefront. This is a permanent licence, not a subscription: it does not renew, it does not expire, and there is nothing to cancel. Local taxes are applied and collected by Apple.

We may change the price of Inkwelo for future purchasers at any time. A change never affects a licence you have already bought.

5. Refunds

All purchases go through Apple, which is the merchant of record. We do not process payments and cannot issue refunds ourselves — Apple does not give developers that ability.

To request a refund, use Apple's own process at reportaproblem.apple.com. Refunds are granted at Apple's discretion under the Apple Media Services Terms.

If you are a consumer in the European Union, the United Kingdom or another jurisdiction with a statutory right of withdrawal or cancellation for digital purchases, that right is provided through Apple as the seller and is unaffected by anything in these terms. The 14-day trial exists precisely so that you can judge whether the app suits you before paying.

6. Your writing is yours

You own everything you write in Inkwelo, in full, without qualification. We claim no licence, no rights and no interest of any kind in it.

Your documents are ordinary Markdown files stored in a folder you choose on your own computer. Inkwelo has no server, no account system and no sync service, so at no point does your work pass through us. We cannot read it, copy it, recover it or delete it, because we never have it.

How we handle the very limited information that does reach us — essentially, emails you send us — is described in the Privacy Policy.

7. Backups and your responsibility for your work

Inkwelo writes your work to disk shortly after you pause typing, and again when you switch away or quit. Even so, software fails, disks fail and mistakes happen.

Keeping backups of your writing is your responsibility. We strongly recommend Time Machine or an equivalent backup, and keeping a copy somewhere other than the Mac you write on. We cannot recover lost work and are not liable for it.

If you place your Inkwelo folder inside iCloud Drive, Dropbox or a similar service, that is your own arrangement with that provider. Such services can and occasionally do produce sync conflicts or lose revisions, particularly if the same folder is edited on two machines at once. Those outcomes are between you and that provider, and we accept no responsibility for them.

8. Updates and availability

Updates to Inkwelo are included with your purchase and delivered through the Mac App Store. We intend to keep improving and maintaining the app, but we do not guarantee any particular update, feature, release schedule or period of support, and features may change or be removed between versions.

We may discontinue the app. If that happens, the copy you have already installed continues to work for as long as it remains compatible with your version of macOS — and because your documents are plain Markdown files, they stay readable in any editor regardless.

Inkwelo includes open-source components, used under their own licences and with thanks:

10. Disclaimer of warranties

Inkwelo is provided "as is" and "as available", without warranty of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, that it will meet your requirements, or that no data will be lost.

Nothing in this section excludes or limits any warranty or guarantee that cannot lawfully be excluded. In particular, if you are a consumer, your mandatory statutory rights under the consumer law of your country of residence — including rights concerning goods and digital content that are not as described or not of satisfactory quality — remain fully intact.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of data, loss of writing, loss of profits or business interruption, arising out of or connected with your use of Inkwelo.

To the fullest extent permitted by law, our total liability for all claims relating to the app is limited to the amount you actually paid for it.

We do not exclude or limit our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, these limits apply only so far as your local consumer law allows.

12. Apple's role

Apple is not a party to these terms and has no responsibility for Inkwelo. Apple has no obligation to provide any maintenance or support for the app. Apple is not responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Any such claim is our responsibility, subject to these terms.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you as a user of the app.

13. Termination

This licence lasts until terminated. It ends automatically if you materially breach these terms, and you may end it at any time by deleting Inkwelo from your devices. Your documents are unaffected either way — they are your files, in your folder, in a plain open format.

The sections on your writing, disclaimers, liability and governing law survive termination.

14. Changes to these terms

We may update these terms as the app changes. We will update the "Last updated" date above, and for material changes we will note them in the app's release notes. Changes are not retroactive, and continued use after a change means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules, and the courts of the Netherlands have jurisdiction over any dispute arising from them.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your own country of residence, and you may also bring proceedings in the courts of that country.
